Fly tipping and waste enforcement


What is fly-tipping?

Fly-tipping simply means the unauthorised depositing of controlled waste on land that does not have a licence to take it.

In other words, it is something more than littering.

The exact details of this offence can be found under Section 33 of the Environmental Protection Act 1990

People who commit this offence are breaking the law and fly-tipping is harmful to the environment, polluting, unpleasant to look at, anti-social and costly to clear up.

What does the council do about fly-tipping?

Every reported fly-tipping is investigated, examined, photographed and then passed on to our contractors to clear.

The evidence is used to establish a name and address, personal bank account details, company names or anything that will point the Enforcement Officer towards the culprit.

This takes a lot of time and effort for something that could be taken to the Household Waste Recycling Centres (HWRC) at Gwalchmai and Penhesgyn, free of charge and dealt with correctly. 

The Authority is not responsible for the cleansing of fly-tipping on private land. Private arrangements will need to be made.

The law

Statute Law imposes punishment on those who commit environmental crime.

Legislation enables us to issue fixed penalty notices and take legal action where necessary.

However, enforcement is a last resort and education is always seen as a better option.

The Waste Management Section will work with residents to provide education and guidance on how to deal with and dispose of waste responsibly.
