Smoking - other issues

Implementing the ban may lead to other issues arising in relation to your business.

Please consider the following:

  • licensed premises will need to think about how their licence conditions may affect the way they deal with the ban. For example, you may have restrictions on the times that external areas such as beer gardens can be used, or a condition preventing re-entry to the premises.For more advice on licensing issues, contact Trading Standards.
  • all premises, particularly those open or working early in the morning or late at night, will need to consider the potential noise impact on nearby properties of patrons or employees congregating outside to smoke
  • you may also wish to consider providing stubbing out bins outside at locations where staff and/or customers may gather to smoke. If you are not creating an outdoor smoking area, you might want to consider providing external stubbing out bins at entrances or exits to keep litter to a minimum.   • if you’re thinking of providing a smoking shelter, you will need to ensure that it complies with the law, i.e. that it is not wholly or substantially enclosed. The definition is in the draft regulations. Once the regulations are enacted, you are advised to seek legal and planning advice on the issue, as what you propose may require planning, building or licensing consent.
