Enforcement of the ban
Enforcement of the ban is being carried out by authorised officers of Anglesey County Council’s Environmental Services Department including officers from Environmental Health, Trading Standards and Licensing.
Monitoring for compliance with the legislation will be carried out during existing inspection regimes for Health and Safety, Food Safety, Licensing and Trading Standards.
Additional visits will also be carried out where complaints are received about smoking in premises.
Visits to check for compliance with the smoking ban will include checks that smoking is taking place, and that all signage is in place.
Initially, any action taken where non-compliances are found will be informal action utilising education and awareness raising.
Where repeated or blatant non-compliance with the legislation is found, officers are authorised to serve Fixed Penalty Notices for failure to display specific signage in a premises, or for smoking in a smoke free premises. For these offences, the individuals may be prosecuted where deemed appropriate.
For permitting smoking to take place in a smoke free premises, the person(s) concerned with the management of a premises could be prosecuted.
